Article 1 — Scope

These General Terms and Conditions of Sale (hereinafter the “GTC”) apply to all sales of physical products carried out by Navy Clic to non-professional consumers (individuals) via the website www.navyclic.com.

Any order placed on the Website implies full and unconditional acceptance of these GTC, which prevail over any other document.

Article 2 — Products

The products offered for sale are those displayed on the Website at the time of consultation by the buyer. Photographs and product descriptions are as accurate as possible but shall not engage the liability of Navy Clic in the event of minor errors or omissions.

Navy Clic reserves the right to modify its product catalogue at any time, without prior notice.

Article 3 — Prices

The prices displayed on the Website are indicated in euros, all taxes included (TTC), with VAT applied at a rate of 20%. Navy Clic reserves the right to modify its prices at any time. Products will be invoiced based on the prices in force at the time the order is validated.

Delivery charges, where applicable, are indicated at the time of basket validation and invoiced in addition to the price of the products.

Article 4 — Order

4.1 — Order process

To place an order, the buyer selects the desired products, adds them to their basket, provides delivery details, chooses a payment method and validates the order.

The order is definitively recorded after payment confirmation. A confirmation email summarising the order is sent to the address provided by the buyer.

4.2 — Availability

Product offers are valid within the limits of available stock. In the event of unavailability of a product after the order has been placed, Navy Clic will inform the buyer as soon as possible and will offer:

  • either to wait until the stock is replenished,
  • or the supply of a substitute product of equivalent quality and price,
  • or a full refund of the amounts paid.

Article 5 — Payment

Payment for purchases is made exclusively by bank card (Visa, Mastercard, national bank card). Payment is secured by a certified payment service provider. Banking details transmitted during payment are encrypted and are never stored by Navy Clic.

The order is validated subject to acceptance of the payment by the banking institution. In the event of refusal, the order is automatically cancelled and the buyer is informed.

Article 6 — Delivery

6.1 — Delivery area

Products are delivered to the delivery address provided by the buyer when placing the order. Navy Clic delivers within mainland France. For any delivery outside this area, the buyer is invited to contact Navy Clic at contact@navyclic.com.

6.2 — Delivery times

Orders are shipped via La Poste – Colissimo. The estimated delivery time is 5 (five) working days from confirmation of the order and payment.

This timeframe is given for information purposes only. Navy Clic shall not be held liable for delays attributable to the carrier or to circumstances beyond its control (force majeure, strikes, weather conditions, etc.).

6.3 — Receipt

Upon delivery, the buyer is invited to check the condition of the parcel and the products in the presence of the delivery person. Any visible damage must be reported immediately to the delivery person and noted on the delivery slip. A report must also be sent to Navy Clic by email at contact@navyclic.com within 48 hours of receipt.

Article 7 — Right of withdrawal

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the buyer has a period of 14 (fourteen) calendar days from receipt of the order to exercise their right of withdrawal, without having to provide reasons or pay penalties.

To exercise this right, the buyer must notify their decision to Navy Clic by email at contact@navyclic.com, stating their order number, before the expiry of the legal 14-day period.

The products must be returned in their original condition, complete and unused, within 14 days following notification of withdrawal.

Return costs are borne by the buyer, unless otherwise expressly agreed by Navy Clic.

The refund will be made within 14 days from receipt of the returned products or proof of shipment, using the same payment method as that used for the order.

Article 8 — Return policy outside withdrawal

Outside the legal withdrawal period, Navy Clic accepts returns within 10 (ten) calendar days from receipt, provided that the products are returned in their original condition, unused, complete and in their original packaging.

Any return must be subject to a prior request by email to contact@navyclic.com, specifying the reason for the return and the order number. Navy Clic reserves the right to refuse a return that does not comply with these conditions.

Article 9 — Legal guarantees

All products sold by Navy Clic benefit from the following legal guarantees, in accordance with the provisions of the French Consumer Code:

  • Legal guarantee of conformity (Articles L.217-4 et seq. of the French Consumer Code): 2 years from delivery of the product;
  • Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the buyer may act within 2 years from the discovery of the defect.

In the event of implementation of these guarantees, the buyer must contact Navy Clic at contact@navyclic.com describing the defect observed and attaching the necessary supporting documents (photos, order number).

Article 10 — Liability

Navy Clic shall not be held liable for total or partial non-performance of its obligations in the event of force majeure, due to the act of the buyer, or due to the unforeseeable and insurmountable act of a third party.

The liability of Navy Clic is limited to the amount of the order concerned, within the limits permitted by applicable law.

Article 11 — Customer service and mediation

For any questions, complaints or requests for information, Navy Clic customer service can be contacted by email at: contact@navyclic.com.

In the event of a dispute not resolved amicably within 60 days from the written complaint addressed to Navy Clic, the buyer may use the online dispute resolution platform provided by the European Commission at: https://ec.europa.eu/consumers/odr.

Article 12 — Applicable law

These GTC are governed by French law. In the event of a dispute and failing an amicable resolution, the courts within the jurisdiction of the registered office of Navy Clic shall have exclusive competence.
